COMBINED TRIP
These General Conditions are subject to the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the defense of Consumers and Users and other laws, Law 7 / 1998, of April 13, on General Conditions of Contract and other provisions in force.
MAZHOUD HALAL TOURISM, S.L. makes available to consumers and users an informative program or brochure that contains in writing the corresponding offer on the combined trip and that must include a clear, understandable and accurate information on the destinations and means of transport, with mention of its characteristics and class , Duration, itinerary and travel calendar.
ACCOMMODATIONS
MAZHOUD HALAL TOURISM, S.L. inform of the list of accommodation establishments, indicating their type, situation, category or level of comfort and their main characteristics, as well as their approval and tourist classification in those countries where there is an official classification.
As well as the number of meals to be served and, if applicable, if drinks or any type of them were not included in the planned diet.
TRAVELERS DOCUMENTATION
General information on the conditions applicable to nationals of the Member States of the European Union regarding passports and visas, and the sanitary formalities necessary for travel and stay.
COMBINED TRIP PRICE
MAZHOUD HALAL TOURISM, S.L. inform you of the full final price of the combined trip, including taxes, and estimated price of optional excursions. In the case of additional expenses corresponding to the services included in the combined trip that the consumer must assume and that are not paid to MAZHOUD HALAL TOURISM, S.L., information about its existence and, if known, its amount.
The amount or percentage of the price to be paid as an advance on the total price and the calendar for the payment of the part of the price not covered by the advance disbursed, as well as the financing conditions that, where appropriate, are offered . If a minimum number of registrations and, in this case, the deadline of information to the consumer and user in case of cancellation is required for the realization of the combined trip. Clauses applicable to possible responsibilities, cancellations. MAZHOUD HALAL TOURISM, S.L. will take care of all the additional and adequate information about the characteristics of the trip offered.
The price of the combined trip has been calculated based on the exchange rates, transport rates, fuel cost, taxes and fees applicable on the date of the program or subsequent editions that, where appropriate, have been made public. printed form.
COMBINED TRAVEL CONTRACT
The combined travel contract must be formulated in writing and contain among its clauses, depending on the characteristics of the offer in question.
The consumer and user will be informed, in advance of the conclusion of the contract, of the content of the contractual clauses and will receive a copy of it, once it has been formalized.
The description of the combined trip communicated by MAZHOUD HALAL TOURISM, S.L., as well as its price and all other conditions applicable to the contract must be truthful and verifiable under the terms established in articles 18 and 60.
MAZHOUD HALAL TOURISM, S.L. provide, in writing or in any other form that is recorded and with the necessary time before the start of the trip, to consumers and users, the schedules and places of the stops and links, as well as the indication of the category of the place that the traveler must occupy in the means or means of transport that will be used.
The name, address and telephone number of MAZHOUD HALAL TOURISM, S.L. or retailer in each destination or, failing that, those of local agencies that can help the consumer and user in case of difficulties. When such representations and organizations do not exist, the consumer and user will have, in any case, an emergency telephone number or any other information that allows him to get in touch.
CANCELLATION EXPENSES
The cancellation of the trip, for any reason that is not attributable to the consumer, entitles you to terminate the contract with the rights provided.
If the trip cancellation is communicated within two months prior to departure, MAZHOUD HALAL TOURISM, S.L. you must pay the consumer compensation according to the time left for departure, which will be at least:
a) 5% of the price of the trip if it takes place more than 15 days in advance and less than 2 months.
b) 10% of the price of the trip, if it takes place between 15 and 3 days in advance.
c) 25% of the price of the trip, if it occurs within 48 hours prior to departure.
There is no obligation to indemnify in the following cases:
a) When the cancellation is due to the fact that the number of people registered is lower than that required in the brochure or in the contract for the combined trip. In this case, the agency must communicate in writing the cancellation to the consumer before the deadline set in the brochure or in the contract. Otherwise, the agency must notify the cancellation at least ten days before the date of departure.
b) When the trip cancellation is due to force majeure reasons. Causes of force majeure are circumstances outside the agency, abnormal and unpredictable whose consequences could not have been avoided, despite having acted with due diligence.
Lack of presentation on departure.
There will be a lack of presentation at the exit if the consumer does not communicate his will not to carry out the trip and does not appear at the time and place provided for the departure. In this case, you lose the right to return the amounts delivered and continue to pay those that were pending payment.
However, if the lack of presentation takes place due to force majeure, the consumer will have the right to be returned the amounts delivered, deducted management fees and cancellation fees. For these purposes, the death, accident or serious illness of the consumer or of any of the persons with whom he lives or any similar assumption preventing him from participating in the trip and communicating to the agency that impossibility before the departure.
Defective compliance or lack of service provision.
When the consumer verifies that during the trip there is a defect or there is a lack of provision of a contracted service, he must notify the organizer or retailer in the same place and as soon as possible and, where appropriate, the service provider concerned. The communication must be carried out in writing or in any other form in which it is recorded. After receiving the communication, the retailer or the organizer must work diligently to find the appropriate solutions.
If you make such communication in the indicated time and form, the document that accredits you will exempt you from providing further evidence about the existence of the defect, unless the organizer, retailer or service provider has verified in the presence of the consumer that the defect does not It exists or does not meet the characteristics indicated, and so they have stated.
If the consumer does not make such communication in the indicated time and form, he must prove the defects that are alleged in accordance with the general test criteria and all damages that occur or that are aggravated by his lack of communication will be of his account.
Impossibility of providing an important part of the services by the organizer.
MAZHOUD HALAL TOURISM, S.L. must adopt the appropriate solutions for the continuation of the trip if once you have started the trip you do not provide or verify that you cannot provide a significant part of the services provided in the contract.
They are an important part of the planned services those whose lack of realization prevents the normal development of the trip and cause that it is not reasonable to expect the average consumer of that type of trip to continue it in these circumstances.
The agency will not be able to request any supplement for the solutions adopted for the continuation of the trip and will pay the consumer any difference between the services provided and those provided.
If the consumer expressly or tacitly accepts the solutions proposed by the agency, he will not be entitled to any compensation for such modifications. It will be considered that you tacitly accept these proposals if you continue the trip with the solutions given by the organizer.
If the solutions adopted by the organizer are not feasible or the consumer does not accept them for reasonable reasons, the agency must:
a) Provide a means of transport equivalent to the one hired on the trip to return to the place of departure or to any other that both have agreed, if the contract includes the return trip.
b) Reimburse the price paid with deduction of the amount of benefits provided to him until the end of the trip, except if the defect that prevents the continuation of the trip is attributable to the consumer.
c) Pay the compensation that may apply.
Consumer withdrawal during the trip.
The consumer has the right to withdraw from the combined travel contract once the trip has begun, but cannot claim the return of the amounts delivered and will continue to be obliged to pay those that are pending payment.
If the withdrawal is due to an accident or a consumer illness that prevents him from continuing the trip, the agency is obliged to provide the necessary assistance and, where appropriate, to pay the amount of the difference between the benefits provided and those provided, deducted the duly justified cancellation fees that apply.
In both cases, all the additional expenses caused by the withdrawal, and in particular those of repatriation or transfer to the place of origin, are borne by the consumer.
INSURANCE
MAZHOUD HALAL TOURISM, S.L. You have subscribed for all your trips a Travel Assistance Insurance that covers the client. Customers will be made available for cancellation insurance and additional risk coverage who may or may not, at their discretion, hire them.
AIR RATES / FLIGHTS
Airfare: These are unified and mandatory taxes that must be included in the plane ticket. These amounts vary according to the date of the trip, the currency exchange, the routes and the stops made. Your final amount will be communicated to you at the time of issuance of air tickets.
Airport taxes: These are entry and exit taxes in each country, which will not be included in airline tickets. Payment is made locally by the passenger at each airport. Fees for fuel increase: These are additional fees that some companies use to regulate the impact of the constant fluctuation of the price of oil. They must also be included in the plane ticket, and their final amount will be notified at the same time as the air fares. The special conditions of the air fares oblige us to inform that the calculated price can be modified depending on the availability of seats.
In the event that international or national flights suffer some type of alterations in their day of operation or schedules, the itineraries may be modified in their order or content. In some cases, certain air stretches will be made with an airline that does not appear on the air ticket or on the reservation confirmation, due to the use of shared codes and alliances between airlines, for which MAZHOUD HALAL TOURISM, SL will not be responsible.
TRANSFERS
The modality of the same shall be specified in every reservation, whether it is a regular or private service. By default they will be regular unless otherwise indicated.
Tips are not included in the package price. In the case of cruises, a complementary contribution is not included in the price of the trip, which usually, although erroneously, is usually referred to as a tip, and whose amount is based on the duration of the trip and has as its sole recipient the service personnel , regarding which at the beginning of the trip the client is warned that he must assume the commitment to deliver at the end of the trip.
VALIDITY
These General Conditions and Provisions will be valid until they are replaced by new ones.
